OSHA lead-exposure case — George Washington Bridge

Under a Port Authority contract begun in 2001, L&L removed lead-based paint from the George Washington Bridge towers by abrasive blasting inside containment enclosures, then repainted them.

In 2004 the New Jersey Department of Health and Senior Services notified OSHA that L&L employees on the bridge had elevated blood lead levels. OSHA inspected the New York-side worksite on July 7 and September 21, 2004. Its industrial hygienist measured airborne lead at 287 and 224 times the permissible exposure limit for two abrasive blasters inside the north-tower containment (who wore blasting hoods and other protective equipment), 170 times for a worker vacuuming inside it, and over three times for a worker vacuuming outside it. Two employees had already been medically removed for elevated blood lead.

OSHA issued a twenty-item serious citation with $33,500 in proposed penalties, mainly under the lead-in-construction standard (29 CFR 1926.62): respirators worn over facial hair, dirty and improperly stored respirators, no initial exposure monitoring on the New York side, compressed air used to clean lead dust, lead accumulations on surfaces, and hygiene failures around washing, showers, clothing and eating areas.

Outcome

Chief Administrative Law Judge Irving Sommer affirmed every item in 2006, and reaffirmed the items the Commission sent back to him in 2009.

On review, the Occupational Safety and Health Review Commission (June 28, 2012) vacated six items — including the coveralls, showers and lunchroom charges — and affirmed the respirator, compressed-air cleaning, lead-accumulation, face-washing and hazard-communication violations as serious, assessing $14,000 for those items. It also let stand the judge's ruling on the initial-monitoring item ($2,000; the two commissioners split, so it carries no precedential weight), and the items L&L did not contest on review stood as the judge decided them.

A companion citation from the New Jersey side (Docket 05-0050) found L&L failed to pay medical removal protection benefits to an employee removed from the bridge job for elevated blood lead. The Commission affirmed that violation on September 29, 2008 and sent the benefit amount back to the judge to recalculate.
